Currently, many Vietnamese citizens also hold foreign nationality (either through naturalization in another country or being born into families with foreign ties). In such cases, when crossing Vietnam’s borders, it is essential to clearly understand the legal regulations on nationality and immigration.

1. Use a Vietnamese passport to protect your rights
According to Clause 2, Article 4 of the 2008 Law on Vietnamese Nationality (amended in 2014), Vietnam recognizes only one nationality Vietnamese except in special cases where the President allows retention of a foreign nationality. Based on Point a, Clause 4, Article 1 of Law No. 51/2019/QH14 (amending the 2014 Law on Exit and Entry), Vietnamese citizens must use documents issued by Vietnamese authorities when entering or leaving the country.

Benefits of using a Vietnamese passport to enter or exit Vietnam:

– You will be fully entitled to the rights and responsibilities of a Vietnamese citizen.

– You do not need to apply for a visa.

– Your stay in Vietnam is not time-limited.

2. Entering Vietnam with a foreign passport: you’ll be considered a foreigner
If a Vietnamese citizen enters Vietnam using a foreign passport, they will be treated as a foreign national. Therefore, they are subject to the following requirements:

– Must apply for a visa or a visa exemption certificate (unless eligible for unilateral or bilateral visa exemption under Vietnam’s agreements). All types of visas come with time limits for stay.

– Must strictly comply with Vietnam’s immigration laws, including: duration of stay, temporary residence registration, declared purpose of entry

Violations of these regulations may result in administrative penalties.
