Vietnam Raises Overstay Fines for Foreigners Under New Decree

Vietnam will significantly increase fines for foreign nationals who overstay their permitted residence, with penalties reaching up to VND 40 million (US$1,520) under Decree 282, effective December 15, 2025. The decree replaces the 2021 regulations and introduces stricter sanctions based on the length of overstay.

Fines range from VND 500,000 – 2 million for overstays under 16 days, rising progressively to VND 40 million for overstays of one year or more. Authorities may also impose deportation for overstays of 16 days or longer. The new maximum fine doubles the previous cap of VND 20 million.



Immigration authorities have advised foreign residents to closely monitor the validity of their residence documents and complete extensions on time, warning that violations may result in fines, deportation, and future entry restrictions.
